Please read all these terms and conditions.
These terms and conditions apply to the purchase of goods by you.
We are Geo plants which is a trading brand of Heaton Gardens. Our VAT number is 352211933.

1. Basis of sale
1.1 The descriptions of the good is as set out on the website. Any description is for illustrative purposes only and there may be small discrepancies of the goods supplied. Pictures of the plants supplied by you can vary in size, shape and density which must be expected with living items.

1.2 All goods which appear on the website are subject to availability.
​
1.3 We can only accept Orders from within our Delivery Area. Please check you are within our Delivery Area.
​
1.4 All orders made to us are special order, if you cancel the order after payment has been made we have a right to charge any restocking, delivery and admin fees which we may incorporate from our partners.

​2. Changes and right to cancel​
2.1 If you wish to make changes to your order please contact us as soon as possible, however changes may not be possible once the order has been placed with our partners.

Rights to cancel
2.3 To cancel your contract you must notify us in writing, either by email or by post.
2.4 There has been an error in the price of the products which you have ordered and you do not wish to proceed
2.5 Delivery of your goods has been significantly delayed from the original date given you for delivery.
3 Cancellation by us
3.1 We reserve the right to cancel the contract between us if:

3.2 we have insufficient stock to deliver the goods you have ordered

3.3 we do not deliver to your area
​
3.4 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing i information received by us from our suppliers.

4 Delivery
4.1 Once the order has been made we will contact you with an approximate delivery date, if you are happy with the date given you will then make full payment on the order.

4.2 Delivery must be inside the UK.
​
4.3 The address which you supply us with is where the items will be delivered, so please check that you have given the right address, once out for delivery we will not be able to make changes to the delivery destination.
4.4 If delivery is to be delayed significantly will get in touch with you to let you know a new delivery date.

4.5 You will be given an option of how you would like the delivery to be made, we use articulated lorries and pallet trucks.
please ensure your selected method of delivery is able to access outside your property.

4.6 Deliveries will be kerb side delivery only, if you select the articulated lorry we cannot guarantee they have a pump truck to unload your goods.
​
4.7 The packaging will be left with you at the point of delivery and it is not the responsibility of the courier to dispose of boxes or pallets. Large orders are sent on pallets and will be left where the couriers can get them to. The drivers will not unload the plants.
5 Liability
5.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we will have no liability to you unless you notify us in writing at our contact address/email of the problem within 3 working days of the delivery of the goods in question.
5.2 If you do not receive goods ordered by you within 10 days of the date on which we notified to you to expect delivery, If you notify a problem to us under this condition, our only obligation will be, at our option:
5.2.1 to make good any shortage or non-delivery;
5.2.2 to replace or repair any goods that are damaged or defective; or
5.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

6. Returns
6.1 You are unable to return any products that you have over-bought, no longer require or purchased in error if the goods are deemed as perishable as per the Consumer Contracts Regulations 2013 (i.e. plants, trees and turf).
